Condition of Service

By creating an account with Alfa Marketplace Inc (hereinafter "Alfa Marketplace" or "we") on the www.alfa.market website (hereinafter "our website"), you agree to the terms and conditions of this agreement (hereinafter "Terms") regarding our services (the "Services"). A link to a copy of the Terms will be emailed to you along with your registration confirmation.
1. SUBSCRIPTION POLICY
Subscription
For subscription : Economy
The Alfa Market membership fee for the Economy plan is 9.95$ per month, with the first month free as a trial. All taxes depending on the billing region are applicable (e.g. GST and QST in Quebec). These fees are monthly, and will be deducted each month in advance according to your membership date. These fees cover only the membership and the opening of your account, and do not cover the payment of any Service or product.
For the subscription: Premium
The Alfa Market membership fee for the Premium package is 19.95$ per month, with the first month free as a trial. All taxes depending on the billing region are applicable (e.g. GST and QST in Quebec). These fees are monthly, and will be deducted each month in advance according to your membership date. These fees cover only the membership and the opening of your account, and do not cover the payment of any Service or product.
Membership Cancellation
You may cancel your membership with Marché Alfa at any time by sending an email to membre@alfa.market. Your membership will be cancelled within 48 business hours. All membership fees paid to Marché Alfa are non-refundable. Upon cancellation of any subscription/membership, you will lose your position in the queue, all sales data, and any credits. Any data retained will be for a period of one (1) year only. The application process will need to be restarted if you decide to re-register.
Shipping benefits and eligible purchases
Alfa Marketplace shipping benefits are subject to restrictions related to availability, order deadlines and shipping address. The shipping area is available at www.alfa.market/pages/couverture.
Other restrictions
- We reserve the right to accept or decline membership at our discretion.
- We may send you emails or other communications related to Alfa Market and your Alfa Market membership (regardless of your Alfa Market account settings or preferences).
- You may not transfer or assign your Alfa Market membership or any Alfa Market benefits, including promotional codes for Alfa Market memberships or benefits, except as permitted in these Terms.
- Alfa Marketplace members may not purchase products for resale, rental or shipment to their customers or potential customers using Alfa Marketplace benefits.
- Some Alfa Marketplace benefits may have specific purchase thresholds or limitations on quantity or shipping address or require members to meet certain criteria.
- From time to time and at its discretion, Alfa Marketplace may add or remove Alfa Marketplace membership benefits in its sole discretion.
Renewal
UNLESS YOU NOTIFY US THAT YOU WISH TO CANCEL OR NOT RENEW AUTOMATICALLY BEFORE AN AMOUNT IS CHARGED, YOU AGREE THAT YOUR ALFA MARKETPLACE MEMBERSHIP WILL CONTINUE AUTOMATICALLY AND YOU AUTHORIZE US (WITHOUT NOTICE TO YOU, UNLESS REQUIRED BY APPLICABLE LAW) TO COLLECT THE THEN-APPLICABLE MEMBERSHIP FEE AND ALL TAXES USING ANY ACCEPTED METHOD OF PAYMENT WE HAVE ON FILE FOR YOU.
Temporary Promotional Memberships
We may from time to time offer our customers promotional membership offers, which are governed by these terms and conditions except to the extent that the promotional offers contain a statement to the contrary.
Termination by Us
We may terminate your Alfa Marketplace membership at our sole discretion, without notice. We will then refund you proportionately based on the number of full months/days remaining in your membership. However, we will not issue a refund with respect to any termination made as a result of any action or conduct that we determine to be in violation of these Terms, or any applicable law, that involves fraud or improper use of the Alfa Marketplace membership, or that is detrimental to our interests or the interests of any other user. The failure of us to insist upon strict performance of these Terms or the failure of us to seek any remedy to enforce them shall not constitute a waiver of our rights.
2. YOUR ACCOUNT
The Alfa Marketplace Services are available to members only. You will need your own Alfa Marketplace account to use the Alfa Marketplace Services and you will need to log into the account and ensure that a valid payment method is specified. If there is a problem with your chosen payment method, we may choose another valid payment method associated with your account. At this time, no payment method will be stored on your account, in accordance with applicable Shopify policy https://www.shopify.ie/security/pci-compliant. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account, and you agree to accept responsibility for all transactions that occur under your account or password. If Alfa Market offers products that are intended for children, it sells them only to adults who can use a credit card or other permitted payment method. If you are under the age of majority in your province or territory of residence, you may use the Alfa Marketplace Services only with the involvement of a parent or guardian. Alfa Market reserves the right to refuse service, terminate accounts, terminate your rights to use the Alfa Marketplace Services, or change the content of our web site or cancel orders, in its sole discretion.
3. PRODUCT DESCRIPTIONS
Any product sold by Alfa Marketplace as part of its Services is referred to in these Terms as a "product" or "item". Alfa Marketplace attempts to be as accurate as possible with respect to the information contained in the Services, the Products, our web site and the Marketplace. However, Marché Alfa does not warrant that product descriptions or other content of any Marché Alfa Services are accurate, complete, reliable, current or error-free. If a product offered by Marché Alfa is not as described, your sole remedy is to return it to us in its original condition.
4. PRICE AND PAYMENT
The term "Catalog Price" means the suggested retail price of a product that is provided by the manufacturer, supplier or vendor. We regularly compare the Catalog Price to recent prices listed on Alfa Marketplace and to prices from other retailers.
For items sold on Alfa Marketplace, we can only confirm the price of an item at the time you offer to purchase it by placing an order. Despite our best efforts, errors may occur in the pricing of some of the items in our catalog. If the correct price for an item sold on Alfa Marketplace is higher than our stated price, we may, at our discretion, contact you for instructions before shipping the item in question or cancel your partial and/or entire order and inform you of the cancellation. Other merchants may follow different policies in the event of a pricing error.
We generally do not charge purchases to your credit card until the shipping process for your order has begun.
All orders to Marché Alfa must be for a minimum amount of 30.00$ before taxes.
Accepted payment methods
Alfa Market accepts several payment methods, including credit and debit cards. You cannot split payment between multiple cards

About taxes
Items sold by Alfa Marketplace and shipped to Canada may be subject to tax.
The taxes collected on purchases of items sold by Alfa Marketplace depend on many factors, including the destination of the shipment and the type of item. For taxable purchases, the following tax rates apply depending on the province or territory to which the goods are shipped.
- Quebec: 9.975% Quebec Sales Tax ("QST") and 5% GST
In general, taxes are calculated on the total selling price of each item.

Free delivery for orders of a minimum of 30,00$ before taxes.

Deliveries are made to individual customers, we can refuse a delivery according to the transactional trend if we judge that it does not respect our conditions and this, at any time.
We consider products to be delivered when the third party delivery service arrives and takes custody of the products in accordance with the delivery instructions you specified in your account, or leaves them in front of the address in the case of non-contact delivery or when no one is available. We will assume that anyone present at the location specified in the delivery instructions is authorized to receive the delivery on your behalf. If there is no one at the address specified in the delivery instructions, or in the case of non-contact delivery, we will leave the package unattended at the address you specified. We are not responsible for any theft of products.
You are responsible for ensuring that the delivery instructions provided to us are complete.
You are responsible for inspecting all products received for any damage or other problems upon delivery. You are responsible for determining the freshness of the products you receive. You must use a thermometer to confirm that the internal temperature of any meat, poultry, fish, seafood or other perishable ingredients is cool and refrigerated below 4°C. If products are not fresh when delivered, please inform us and we will address the issue in accordance with our return policy.
If your order is delivered in boxes, these include insulated liners and ice gel packs that keep your ingredients cool for up to 24 hours after delivery. However, you are responsible for the products from the time the delivery person relinquishes custody of the products in accordance with the instructions in your account or this section. You are responsible for any degradation of the product resulting from any event (including the passage of time) after delivery of the products. Please keep in mind the season and temperatures in your area at the time of delivery and plan deliveries and storage accordingly.
Upon receipt and inspection of any delivered product, you must immediately refrigerate all perishable items and are responsible for following the refrigeration, food safety, safe food handling and food consumption recommendations of the Ministère de l'Agriculture, des Pêcheries et de l'Alimentation du Québec (MAPAQ) and the Canadian Food Inspection Agency (CFIA) to reduce the risk of foodborne illness, including recommendations for at-risk groups (i.e. pregnant women, children and youth).(i.e. pregnant women, young children, the elderly and people with weakened immune systems). You should use a food thermometer to ensure that all applicable meats, poultry, fish, seafood and other items are cooked to recommended internal temperatures.
6. RETURNS AND REFUNDS
If you are not satisfied with a product you receive, please contact us at membre@alfa.market within five (5) days of receiving your order. This time limit does not apply to certain meats such as ground beef or seafood. In these cases and only, the consumption period will correspond to the date following the mention: "Best before" or "Consume before". Any refunds we decide to give are in the form of store credit. In exceptional situations, we may refund to your credit card. We may require you to either (i) return, at your expense (unless otherwise agreed with us), the product with which you are not satisfied; (ii) retain the product; and/or (iii) provide photographic documentation of the product with which you are not satisfied. You are responsible for inspecting the products upon delivery for any damage or other problems, including, but not limited to, the freshness of the products you receive. Ingredients must be delivered to you cool and refrigerated, below 4°C. Although unlikely, if you have reason to believe that any product in your delivery is not fit for consumption, please contact us immediately at membre@alfa.market.
Title to returned items does not pass to Marché Alfa until the items arrive at our distribution center. We may issue a refund, at our discretion, without requiring a return. In such a case, title to the refunded items does not pass to Alfa Market. If we receive items that do not meet the criteria set forth in our return policies, including items that are returned after the eligible return date, items that have been opened or damaged, we may charge a restocking fee or issue a partial refund.
7. COPYRIGHT
All content included in or made available through an Alfa Marketplace Service or the design of its web sites or "Marketplace", such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, and any compilation thereof, is the property of Alfa Marketplace or its content suppliers and protected by Canadian and international copyright laws.
We respect the intellectual property rights of others. If you believe that any material contained on the Services infringes a copyright that you own and control, you may send us an alert telling us where that material is incorporated into a Service or send us written notice of such infringement. If we receive notice of alleged infringement, we will investigate the complaint and, if we determine that it is justified, we will remove or disable the allegedly infringing material.
8. TRADEMARKS

The slogans: Groceries has never been so pleasant. Groceries has never been In addition, the graphics, logos, page headers, button icons, scripts and service names appearing on or made available through an Alfa Marketplace Service, our web site or the Marketplace are trademarks or trade dress of Alfa Marketplace. The trademarks and trade dress of Alfa Marketplace may not be used in connection with any product or service that is not Alfa Marketplace. All other trademarks not owned by Alfa Market that appear on any of the Alfa Market Services are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Alfa Market or its affiliates.
9. LICENSE AND ACCESS
Subject to your compliance with these Terms, and payment of all applicable fees, Alfa Marketplace or its content providers grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal, non-commercial use of the Alfa Marketplace Services. This license does not include any resale or commercial use of any Alfa Marketplace Service or its contents, any creation and use of product listings, descriptions or prices, any derivative use of any Alfa Marketplace Service or its contents, any downloading, copying or other use of account information for the benefit of any third party, or any use of data mining, harvesting or extraction tools. Alfa Market or its licensors, suppliers, publishers, rights holders or other content providers retain and reserve all rights not expressly granted to you in these Terms. No Alfa Marketplace Service may be reproduced, copied, sold, resold, visited or otherwise exploited for any commercial purpose, in whole or in part, without the express written permission of Alfa Marketplace. You may not frame any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Marché Alfa without express written permission. You may not use any meta tags or any other "hidden text" utilizing Alfa Market's name or trademarks without the express written permission of Alfa Market. You may not make any improper use of the Alfa Marketplace Services. You may use the Alfa Marketplace Services only as permitted by law. The licenses granted by Alfa Market will terminate if you fail to comply with these Terms.
10. DISCLAIMER OF LIABILITY
Alfa Market attempts to ensure that all information contained on its Services remains accurate and current, but we cannot guarantee its accuracy, completeness or quality at all times.
Your use of the Services is at your own risk.
The Services, products and all materials on our Services and Web site are provided on an "as is" basis. This means that Alfa Market disclaims all express and implied warranties about its Services, products and materials found on its Services and our web site. This includes (but is not limited to) warranties that the products and materials are of particular quality or fit for a particular purpose, that the functional aspects of the materials will be uninterrupted and error-free, that our Services or the servers that make them available are free of viruses or other harmful components, and that you will obtain good results by following the instructions, directions or recipes provided in the materials.
You must take precautions to ensure that whatever you access or download is free of viruses, worms, Trojan horses and other items of a destructive nature. Access to the Services is never guaranteed.
Our Services may contain links to third party websites. However, we do not control third party websites and are not responsible for the content of such sites. If you access such third party web sites, you do so at your own risk, as Alfa Market does not review or verify the information contained therein.
11. LIMITATION OF LIABILITY
THE LAWS OF SOME JURISDICTIONS, INCLUDING THE CONSUMER PROTECTION ACT OF QUEBEC, DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY OR CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, ONE OR MORE OF THE DISCLAIMERS OR LIMITATIONS BELOW MAY NOT APPLY TO YOU, AND YOU MAY HAVE OTHER RIGHTS.
Alfa Market shall not be liable for any damages, injury or death arising out of or resulting from the use of the Services, including as a result of ingesting the Products. This includes (but is not limited to) any injury or damage caused by the use of or inability to use the Services, the use of (or inability to use) any web site accessed through a link on our Services, any failure of performance, error, omission, interruption, defect, delay in operation or transmission, computer virus or communication line failure.
Alfa Market shall not be liable for any damages, including damages to compensate anyone directly for any loss or injury or personal injury, damages that may reasonably be expected to result from any loss or injury or personal injury (consequential damages), or damages and expenses of any kind directly resulting from any loss or injury or personal injury (incidental damages). In addition, we shall not be liable even if we have been negligent or if one of our authorized representatives had been advised of the possibility of such damage.
Without limiting the foregoing, Alfa Market shall not be liable for any delay in performance or failure to perform any of its obligations under these Terms or in connection with any transaction or attempted transaction in connection with the Services if the delay in performance or failure to perform is due to circumstances beyond its reasonable control.
Allergies: When completing the application form for the Services, you will be asked to specify if you have any allergies. Alfa Market assumes no responsibility for your food allergies and your sole remedy will be to request a refund if we deliver food to you that you have chosen not to order because of your allergies.
In all cases, our liability to you for loss, damage, injury or bodily harm and claims of any kind (whether the damages are claimed in contract, negligence, other wrongful conduct or any other legal theory) is limited to the amount you paid, if any, to access our Services, including the purchase price of the products giving rise to the claim. You acknowledge that if no fees are paid for the use of the Services or the purchase of products giving rise to the claim, you will be limited to injunctive relief only, except as permitted by law, and will not be entitled to any damages of any kind, regardless of the cause of action.
12 INDEMNITY
You agree to indemnify and hold harmless Marché Alfa, its subsidiaries and affiliates, and their respective directors, officers, agents, contractors and employees from and against any and all losses, liabilities, claims, demands, damages, costs and expenses of any kind, including reasonable attorneys' fees, with respect to any content you post or share on or through the Services, your use of the Services, or any content, information or products offered, accessed or ordered or purchased through the Services, your conduct with respect to the Services or other users of the Services, or any violation of these Terms, any law or the rights of any third party.
13. TRANSACTION TERMS
The following additional terms and conditions apply to Alfa Marketplace Web sites that allow users to order or purchase products or services online ("Transactional Sites"). In the event of any inconsistency between these Transaction Terms and the Terms of Use set forth above, the Transaction Terms shall prevail. You should also consult the Frequently Asked Questions ("FAQs") on our Transactional Sites, if any, which may contain helpful information. In the event of any discrepancy between the Transaction Terms and any FAQs, the Transaction Terms shall prevail.
A particular transactional site may contain its own transactional terms and conditions. Those terms and conditions supersede these Transactional Terms and Conditions with respect to that Transactional Site, unless otherwise specified in these Transactional Terms and Conditions.
Products purchased or ordered on transactional sites that allow delivery may only be delivered to the geographic areas indicated on the applicable transactional site. Products purchased or ordered on Transactional Sites that allow pickup may only be picked up in the geographic areas and at the stores indicated on the applicable Transactional Site.
Alfa Market may, in its sole discretion, accept or decline any order placed on a Transactional Site. All offers on the Transactional Sites are invitations to purchase and not offers to sell. Any confirmation of receipt of an order placed online is an acknowledgement and not an acceptance of the order, which will be sent to you at the email address associated with the account, or by telephone at the telephone number provided.
Alfa Market may, in its sole discretion, cancel an order placed by you on a transactional site after it has been accepted, in which case you will be notified at the contact information provided. If Marché Alfa cancels your order, Marché Alfa will have no obligation or liability to you with respect to such order and you will not be required to pay for it. In certain circumstances, Marché Alfa may require additional information or verification before accepting or fulfilling an order, in which case you will be notified at the contact information provided.
Subject to applicable law: (a) the purchase of Products on the Transactional Sites is subject to availability. If the Product(s) is (are) not available, Marché Alfa will not be obligated to fulfill any order for such Product(s) and you will not be obligated to pay Marché Alfa for such Product(s); and (b) Marché Alfa reserves the right to substitute the Product(s) and to change the price(s) and description(s) advertised or displayed on any of the Transactional Sites at any time without any notice or obligation to you.
Alfa Market strives to provide accurate product descriptions, but does not warrant the accuracy, reliability, timeliness or completeness of the product descriptions or other information provided on the Transactional Sites.
Alfa Market reserves the right, in its sole discretion, to limit the quantities of items purchased per person, per household or per order, or otherwise, from time to time. You will be notified at the contact information provided if such limits or prohibitions apply to any of your orders.
With respect to transactional sites from which age-restricted products (e.g., having reached the age of majority) may be ordered in that jurisdiction in order to order them (e.g., beer and wine), only persons who have reached that age in that jurisdiction may order such products. By ordering such products, you represent that you have reached the required age. Proof that you have reached the age of majority for the purchase of such products will be requested upon delivery (driver's license, passport or citizenship card).
The payment methods applicable to a particular order are indicated on the transactional site where the order is placed. You authorize Alfa Marketplace to process payment of the applicable purchase price by the method of payment you choose from those offered, and you represent and warrant that you are authorized to use the applicable card. If your payment is made by credit card and is rejected by the card issuer or processor, your order will not be processed and Marché Alfa will have no obligation to do so.
The version of these Terms and Conditions (including, without limitation, the Transaction Terms and Conditions) that applies to an order or other transaction placed by you on a Transaction Site is the version in effect at the time and date you place your order, as posted on the applicable Transaction Site at that time. Each time you place an order, you represent and warrant that you have viewed, read and agree to the terms and conditions then governing that order
14. APPLICATIONS
When you use applications created by Alfa Marketplace, if any, you may grant us certain permissions to use your device. Most mobile devices provide you with information about these permissions. Any Alfa Market application may be subject to separate terms of use, which you will be made aware of at the time of installation or use.
15. SITE POLICIES, CHANGES, SEVERABILITY AND OTHER
Please read our other policies and terms, such as our Privacy Policy and Terms of Use, which are posted on our web site. These policies and terms also govern your use of the Alfa Marketplace Services. We reserve the right to make changes to our Web Site, policies, terms and conditions and these Terms and Conditions at any time at our discretion and without notice to you. YOUR CONTINUED MEMBERSHIP AFTER ANY SUCH CHANGE CONSTITUTES YOUR ACCEPTANCE OF THOSE CHANGES. IF YOU DO NOT AGREE TO ANY SUCH CHANGES, YOU MUST CANCEL YOUR MEMBERSHIP. If any of these terms shall be deemed invalid, void or for any reason unenforceable, such term shall be deemed severable and shall not affect the validity and enforceability of any remaining term. These terms and conditions are governed by the laws of the Province of Quebec and the laws of Canada applicable therein.
